Terms & Services

Effective date: November 1, 2025

These Terms & Services ("Terms") govern your access to the website republicanguilt.com (the "Site") operated by Republican Guilt Home Warranty ("Republican Guilt," "we," "us," or "our") and describe general conditions relating to our home warranty service agreements ("Plans"). By using the Site, submitting forms, or enrolling in a Plan, you agree to these Terms. If you do not agree, do not use the Site or enroll.

Your specific Plan is governed by the signed service agreement, declarations page, and coverage schedule issued at enrollment (collectively, the "Service Agreement"). If these Terms conflict with your Service Agreement, the Service Agreement controls for coverage matters.

1. Eligibility & Accounts

You must be at least eighteen years old and able to form a binding contract to enroll or use account features. You are responsible for maintaining accurate enrollment information, including property details, covered items, and contact email. Misrepresentation of property condition, prior damage, or equipment age may void coverage for affected items.

2. Nature of Home Warranty Coverage

A home warranty is a service contract that covers repair or replacement of specified systems and appliances due to normal wear and tear. It is not homeowner's insurance, flood insurance, or a substitute for property insurance. We do not cover structural components, pre-existing conditions known to you at enrollment, intentional damage, code violations unless required for a covered repair, or failures caused by lack of maintenance, misuse, or acts of nature unless expressly stated.

Coverage begins after any applicable waiting period shown on your Service Agreement. Optional add-ons may have separate waiting periods and caps.

3. Enrollment, Fees & Billing

Quoted prices on the Site are estimates only. Final pricing appears on your Service Agreement. You agree to pay plan premiums, service call fees, and any applicable taxes on the billing cycle you select. Late or failed payments may suspend coverage until balances are cured. Reinstatement may require inspection or updated disclosures.

Service call fees are due to the contractor at time of visit unless your Plan states otherwise. Approved repair or replacement costs beyond the service call fee are handled according to per-item caps, trade caps, and guidelines in your Service Agreement.

4. Filing Claims & Service Performance

Claims must be submitted while the Plan is active and for failures occurring during the coverage period. You must provide reasonable access to the property and covered items. We assign independent contractors; appointment windows depend on availability, geography, and seasonality. We do not guarantee same-day service except where a Plan expressly includes priority dispatch.

We may repair, replace, or offer cash compensation at our discretion within coverage limits. Replacement equipment may be of like kind and quality, which may differ from original brand or finish. Cosmetic matching is not guaranteed unless required by your Plan.

5. Exclusions & Maintenance

Standard exclusions include but are not limited to: commercial use equipment unless endorsed, improper installation, rust or corrosion, sediment damage, recalled items, permits pulled by others, and items excluded on your declarations page. You must maintain equipment per manufacturer guidelines and applicable law. We may request maintenance records for certain claims.

6. Cancellations & Transfers

You may cancel according to the cancellation section of your Service Agreement, which may include prorated refunds or cancellation fees depending on billing method and state requirements. Plans may be transferable at sale of property when fees and documentation requirements are met. Transfer does not automatically increase caps or extend waiting periods.

7. Website Use & Acceptable Conduct

You may use the Site for lawful purposes only. You may not attempt unauthorized access, scrape content in bulk, introduce malware, interfere with Site operation, or use the Site to harass staff or contractors. We may suspend access for violations.

8. Intellectual Property

Site content, logos, text, graphics, and layout are owned by Republican Guilt or licensors and protected by intellectual property laws. You receive a limited, non-exclusive license to view content for personal, non-commercial use. You may not reproduce, distribute, or create derivative works without written permission.

9. Communications & Electronic Records

By providing your email, you consent to receive service messages, claim updates, and marketing if you opt in. You may opt out of marketing via unsubscribe links or the unsubscribe page on this Site. Transactional messages related to active Plans may continue while enrolled.

10. Disclaimers

THE SITE AND GENERAL INFORMATION ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PLAN COVERAGE IS DEFINED ONLY IN YOUR SERVICE AGREEMENT. WE DO NOT WARRANT UNINTERRUPTED SITE ACCESS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPUBLICAN GUILT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM SITE USE OR PLAN ADMINISTRATION. OUR AGGREGATE LIABILITY FOR SITE-RELATED CLAIMS NOT GOVERNED BY YOUR SERVICE AGREEMENT SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12. Dispute Resolution

Disputes relating to these Terms or the Site shall first be submitted to support@republicanguilt.com for informal resolution. If unresolved, disputes shall be resolved by binding arbitration on an individual basis, except where prohibited by law. Class actions and representative proceedings are waived to the extent permitted. Nothing prevents either party from seeking injunctive relief for intellectual property misuse.

13. Governing Law

These Terms are governed by the laws of the state specified in your Service Agreement, without regard to conflict-of-law rules. If no state is specified, the laws of the state of our principal place of business apply.

14. Changes

We may update these Terms by posting a revised version on the Site with a new effective date. Material changes to active Plans require notice as set forth in your Service Agreement. Continued Site use after changes constitutes acceptance of updated Terms for Site purposes.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. The invalid provision shall be replaced with a valid term that most closely reflects the original intent.

17. Entire Agreement (Site)

These Terms, together with the Privacy Policy and any supplemental notices posted on the Site, constitute the entire agreement between you and Republican Guilt regarding use of the Site. Coverage matters are governed solely by your Service Agreement.

18. Service Agreement Highlights

While your Service Agreement controls, the following principles commonly apply to Republican Guilt Plans: (a) covered items must be in good working order at enrollment unless disclosed; (b) duplicate coverage with other warranties may reduce our obligation; (c) code upgrades are included only when required to complete a covered repair; (d) hazardous conditions must be disclosed before dispatch; (e) repeated failures on the same item may be subject to caps or alternative remedies.

Sample schedules available on request illustrate typical per-item limits for HVAC, water heaters, electrical panels, and major appliances. Your declarations page lists the exact items and limits applicable to your property.

19. Indemnification

You agree to indemnify and hold harmless Republican Guilt and its affiliates from claims arising from your misuse of the Site, violation of these Terms, or misrepresentation of property condition, except to the extent caused by our gross negligence or willful misconduct.

20. Force Majeure

We are not liable for delays or failures resulting from events beyond reasonable control, including severe weather, natural disasters, labor disputes, supply chain interruptions, or government orders. During such events we will use commercially reasonable efforts to restore service scheduling.
